PROVIDING SUBSIDIES TO RUSSIAN

TO ORGANIZATIONS FOR COMPENSATION OF PART OF THE COSTS OF CONDUCTING

RESEARCH AND DEVELOPMENT WORKS,

INCURRED IN 2017 - 2019 DURING IMPLEMENTATION

COMPLEX INVESTMENT PROJECTS BY ORGANIZATION

1. These Rules establish the goals, conditions and procedure for providing subsidies from the federal budget Russian organizations to compensate for part of the costs of research and development work incurred in 2017 - 2019 as part of the implementation of complex investment projects to organize the production of rehabilitation means (hereinafter referred to as organizations, subsidies).

2. In these Rules, the concept of “complex investment project” is understood as a set of interrelated activities and processes to create products for the rehabilitation industry market, limited in time and resources, which may include:

carrying out research work;

carrying out development work;

organizing the release of a trial batch of products;

conducting testing (trial operation) of products in order to improve the technical and consumer properties of the product;

commercialization of completed research and development work.

3. Subsidies are provided within the framework of the subprogram “Promotion of scientific research and experimental development in civil industries” of the state program of the Russian Federation “Development of industry and increasing its competitiveness” (hereinafter - Government program) in order to stimulate the activities of organizations in the rehabilitation industry in 2017 - 2019 in the development and production of goods that are intended for persons with disabilities health (sick, disabled, elderly people, children, women during pregnancy, childbirth and the postpartum period) and are focused on creating equal opportunities for them, along with other members of society, to carry out life activities, including technical means rehabilitation (including medical complexes and equipment, mechanical correction systems for the musculoskeletal system, prosthetic organs and limbs), as well as products and devices that provide a barrier-free living environment for persons with disabilities (hereinafter referred to as products), which will contribute to the achievement of performance indicators implementation of a comprehensive investment project established by the state program.

4. Subsidies are provided within the limits of budgetary allocations provided for by the federal law on the federal budget for the corresponding financial year and planning period, and the limits of budgetary obligations communicated in the prescribed manner to the Ministry of Industry and Trade of the Russian Federation as the recipient of federal budget funds for the purposes specified in paragraph 1 of these Rules.

Subsidies are provided to organizations that have passed a competitive selection for the right to receive a subsidy, within the framework of technological areas determined in accordance with the list specified in paragraph 6 of these Rules, to reimburse the costs of carrying out research and development work as part of the implementation of complex investment projects, in which the period for implementation of the specified works does not exceed 3 years (hereinafter referred to as the competition). The maximum amount of subsidies provided to an organization is 200 million rubles, including for testing (trial operation) of products - no more than 30 million rubles (if carried out).

5. Subsidies are provided to organizations that, as of the date no earlier than the 15th day of the month preceding the month in which it is planned to conclude an agreement on the provision of a subsidy, meet the following conditions:

a) the organization does not have an unfulfilled obligation to pay taxes, fees, insurance premiums, penalties, fines and interest payable in accordance with the legislation of the Russian Federation on taxes and fees;

b) the organization has no overdue debt for the return to the federal budget of subsidies, budget investments provided in accordance with other legal acts, and other overdue debt to the federal budget, including for monetary obligations to the Russian Federation, defined in Article 93.4 of the Budget Code of the Russian Federation Federations;

c) the organization is not in the process of reorganization, liquidation or bankruptcy;

d) the organization is not a foreign legal entity, as well as a Russian legal entity, in the authorized (share) capital of which there is a share of participation of foreign legal entities whose place of registration is a state or territory included in the list of states and territories providing preferential benefits approved by the Ministry of Finance of the Russian Federation the tax regime for taxation and (or) those that do not provide for the disclosure and provision of information when conducting financial transactions (offshore zones), in total exceeds 50 percent;

e) the organization does not receive funds from the federal budget in accordance with other regulatory legal acts for the purposes provided for in paragraphs 1 and these Rules;

f) a complex investment project relates to one of the technological areas determined in accordance with the list specified in paragraph 6 of these Rules.

6. The list of technological areas for which subsidies will be provided is determined by the Scientific and Technical Council for the Development of the Production of Industrial Rehabilitation Products under the Ministry of Industry and Trade of the Russian Federation.

7. The subsidy is provided to compensate for the following actually incurred and documented expenses of the organization within the framework of a comprehensive investment project:

a) expenses for remuneration of workers directly involved in research and development work, development work, work on the production of a trial batch of products, work on testing (trial operation) of products (but not more than the average salary for a given subject of the Russian Federation for previous quarter), as well as expenses for compulsory pension insurance, compulsory social insurance in case of temporary disability and in connection with maternity, compulsory medical insurance, compulsory social insurance against industrial accidents and occupational diseases, accrued on the specified amounts of labor costs;

b) overhead costs in the amount of no more than 100 percent of the amount of labor costs directly related to the implementation of a comprehensive investment project, including testing (trial operation) of products;

c) the cost of work (including services of third parties if they are involved, including individuals - disabled people and legal entities involving disabled people) under contracts for the implementation of research and development work directly related to the implementation of a comprehensive investment project, in including testing (trial operation) of products;

d) expenses for the production of prototypes, mock-ups and stands, including the purchase of materials and components, as well as for testing (trial operation) of products;

e) costs for the production of a pilot batch of products and its testing, certification and (or) registration, as well as testing;

f) expenses under lease agreements for technological equipment and technological equipment necessary for carrying out research and development work;

g) costs for the manufacture and (or) acquisition of equipment, testing, measurement and control tools, consumable tools for testing (trial operation) of products;

h) expenses under life and health insurance contracts for persons participating in the testing (trial operation) of products (if carried out) created as part of a comprehensive investment project, in the absence of these conditions in the contracts subject to compensation in accordance with subparagraph "c" of this paragraph.

8. The organization is obliged to keep separate records of costs for the implementation of the project.

The Ministry of Industry and Trade of the Russian Federation makes a decision to hold a competition taking into account the budgetary allocations provided for by the federal law on the federal budget for the corresponding financial year and planning period, and the limits of budget obligations communicated in the prescribed manner to the Ministry of Industry and Trade of the Russian Federation as the recipient of federal funds budget for the purposes specified in paragraphs 1 and these Rules, as well as taking into account the limits of budgetary obligations necessary to complete the provision of state support for complex investment projects in accordance with previously concluded subsidy agreements.

a) determines performance indicators for the implementation of complex investment projects for each technological area;

b) determines the requirements for the content and design of the business plan of a comprehensive investment project submitted for participation in the competition, and places them on the official website of the Ministry of Industry and Trade of the Russian Federation on the information and telecommunications network "Internet" (hereinafter referred to as the "Internet");

d) determines the minimum volume of sales of innovative products in technological areas that will be created using the results of research and development work, indicating it in the competition documentation;

E) approves the methodology for conducting an examination of the results of the implementation of a complex investment project and places it on its official website on the Internet.

a) receipt of total proceeds from the sale of products produced within the framework of a comprehensive investment project in an amount exceeding 2 times the amount of the subsidy provided for carrying out research work, carrying out experimental design work and work on the production of a trial batch of products, or in the amount , exceeding 3 times the amount of the subsidy provided for testing (trial operation) of products, in proportion to the subsidy received in the areas of costs for no more than 3 years after the start of production of products under the project.

b) the number of newly created and modernized high-performance jobs as part of the implementation of a comprehensive investment project, amounting to at least 50 percent of the number of employees directly involved in research and development work within the framework of a comprehensive investment project;

c) the ratio of the size of the subsidy and the size extrabudgetary funds, planned to be attracted for the implementation of a comprehensive investment project, which must be at least 2 times the amount of the requested subsidy, excluding the costs of testing (trial operation) of products (if carried out);

d) the number of patents and (or) production secrets (know-how) received;

e) the period for the implementation of a complex investment project (the period within which it is expected to ensure the achievement of all declared performance indicators for the implementation of a complex investment project, including during testing (trial operation) of products), but not more than 6 years;

f) the volume of exports of products that will be created during the implementation of a comprehensive investment project, but not less than 1 percent of the total volume of products produced for the specified period.

12. For the purpose of holding a competition, the Ministry of Industry and Trade of the Russian Federation places on its official website on the Internet a notice of the competition, indicating the timing of its holding and competition documentation, containing the following information:

b) requirements for the form and composition of the application;

d) place, procedure, date and time of opening envelopes with applications;

e) draft agreement on the provision of subsidies.

c) information on the average number of employees of the organization for the year preceding the calendar year of filing the application, presented in a form approved by the Federal Tax Service, as well as a certificate of the presence of personnel of at least 15 people on the organization’s staff, signed by the head of the organization and certified by a seal (if any ) organizations;

d) a certificate, drawn up in any form, about the presence of total revenue for the 36 months preceding the month of filing the application, at least 50 million rubles, signed by the head of the organization and certified by the seal (if any) of the organization, with copies of supporting documents attached;

e) a certificate, drawn up in any form, on the provision of the organization with technological and testing equipment for the implementation of a complex investment project, owned by right of ownership or on another legal basis of the organization or its subsidiaries or organizations in relation to which it is a subsidiary, located in the territory Russian Federation, signed by the head of the organization and certified by the seal (if any) of the organization, with copies of supporting documents attached;

f) copies of documents confirming that the organization has the buildings, structures and structures necessary for the implementation of a complex investment project and owned by it or on another legal basis, the rights to which are not registered in the Unified State Register of Rights to Real Estate and Transactions with It;

g) a certificate, drawn up in any form, about the presence of successful experience in the implementation of such complex investment projects, including in bringing them to the planned payback, ensuring the achievement of the planned performance indicators for the implementation of a complex investment project, signed by the head of the organization;

h) a certificate of the name of the product that will be created during the implementation of a comprehensive investment project;

i) a certificate from the tax authority confirming that the organization, as of a date not earlier than the 15th day of the month preceding the month in which it is planned to conclude an agreement on the provision of a subsidy, has no unfulfilled obligation to pay taxes, fees, insurance premiums, penalties, fines and interest payable in accordance with the legislation of the Russian Federation on taxes and fees (if the organization fails to provide such a document, the Ministry of Industry and Trade of the Russian Federation requests it independently);

j) information about the organization’s implementation of work on the implementation of a comprehensive investment project at the expense of its own and (or) borrowed funds at the time of filing the application, indicating the volume of actual costs incurred and work performed;

k) a business plan for a complex investment project, including a marketing analysis with justification of demand for products that will be created during the implementation of a complex investment project, indicating performance indicators for the implementation of a complex investment project based on the results of each half-year of its implementation, including a schedule for the implementation of a complex investment project project, containing key events and results of the implementation of the specified project, including qualitative and quantitative characteristics achieving, using subsidy funds, performance indicators for the implementation of a complex investment project, as well as the structure of planned costs associated with the implementation of a complex investment project, which involves carrying out research and development work, production and sales of products, as well as attracting investments in the form of borrowed or own funds of the organization (hereinafter referred to as the business plan, schedule), including information:

O technical specifications products planned for development as part of research and development work and used to create products as part of a comprehensive investment project;

on the volume of production and sales of products that will be created during the implementation of a comprehensive investment project;

about the amount of the subsidy;

on the share of innovative products in the total volume of products produced by the organization;

on the number of patents expected to be obtained;

on the number of newly created and modernized high-performance jobs as part of the implementation of a comprehensive investment project;

on the implementation period of a complex investment project;

on the volume of exports of products that will be created during the implementation of a comprehensive investment project;

on the financial indicators of the implementation of a complex investment project - net present value and internal rate of return;

l) letters of guarantee from investors (co-investors) and (or) credit institutions about their readiness to provide financial support for expenses associated with the implementation of a complex investment project, if it is necessary to attract credit funds for the purpose of implementing a complex investment project. These letters must contain data on the effectiveness of planned investments in a complex investment project, obtained on the basis of an analysis of the business plan;

m) an extract from the Unified State Register of Legal Entities, certified in the prescribed manner (if the organization fails to provide such a document, the Ministry of Industry and Trade of the Russian Federation requests it independently);

o) a certificate signed by the head of the organization confirming the organization’s compliance as of a date no earlier than the 15th day of the month preceding the month in which it is planned to conclude an agreement on the provision of a subsidy with the requirements established by subparagraphs “b” - “d” of paragraph 5 of these Rules;

o) a program for testing (trial operation) of products (if carried out), which is created as part of the implementation of a comprehensive investment project and is developed in accordance with the requirements established by the methodology for testing (trial operation) of innovative rehabilitation products with the participation of people with disabilities, approved by the Ministry of Industry and trade of the Russian Federation;

p) a copy of the registration certificate for a medical product (provided that the product being developed is a medical device) when compensating the costs of implementing a complex investment project at the stage of testing (trial operation) of the product.

a) compliance of the submitted documents with the requirements provided for in paragraph 13 of these Rules, and submission of these documents in full;

b) the reliability of the information contained in the submitted documents;

c) the absence of contradictory information in the submitted documents;

d) compliance of the application with the technological areas determined in accordance with the list provided for in paragraph 6 of these Rules;

e) the organization does not have any previously completed subsidy agreements with the Ministry of Industry and Trade of the Russian Federation included in the register of complex investment projects for organizing the production of rehabilitation means, within the framework of which the subsidy provided for in paragraph 21 of these Rules is provided.

a) registers, in the order of receipt, envelopes with applications and documents specified in paragraph 13 of these Rules in a special journal, which must be laced, numbered sheet by page and sealed with the seal of the Ministry of Industry and Trade of the Russian Federation;

b) opens envelopes with applications and documents in the manner and within the time limits specified in the notice of the competition, and checks the correctness of execution and completeness of the documents provided for in paragraph 13 of these Rules. Based on the results of opening these envelopes and checking organizations for compliance with the conditions for admission to the competition, provided for in paragraph 14 of these Rules, a protocol for opening envelopes with applications and documents is drawn up, containing a list of organizations admitted to participate in the competition, which is signed by all present members of the commission and posted on the official website of the Ministry of Industry and Trade of the Russian Federation on the Internet no later than 1 business day following the day of opening of the specified envelopes;

c) checks, within 10 working days from the date of signing the protocol for opening envelopes with applications and documents, the compliance of documents with the conditions for providing a subsidy and compiles a rating of applications in accordance with the criteria specified in paragraph 11 of these Rules using the methodology provided for in Appendix No. 1 to these Rules. Based on the ratings of applications, the competition commission assigns a serial number to each application. Based on the results of the evaluation and comparison of applications, a protocol for the evaluation and comparison of applications is drawn up no later than 3 business days following the day the evaluation and comparison of applications ends. The protocol for assessing and comparing applications is drawn up in 1 copy, which is stored in the Ministry of Industry and Trade of the Russian Federation;

d) within 5 working days from the date of signing the protocol for evaluating and comparing applications, transfers to the winner (winners) of the competition a copy of the protocol for evaluating and comparing applications and the draft agreement on the provision of a subsidy, attached to the competition documentation and containing the terms of execution of the agreement proposed by the winner of the competition in the application. The protocol for evaluating and comparing applications is posted on the official website of the Ministry of Industry and Trade of the Russian Federation on the Internet no later than 1 business day following the day of its signing;

e) signs an agreement on the provision of a subsidy with the winner (winners) of the competition or with the only participant admitted to participate in the competition, no earlier than 10 working days and no later than 20 working days from the date of posting on the official website of the Ministry of Industry and Trade of the Russian Federation on the Internet " Internet" protocol for evaluating and comparing applications.

17. If the winner of the competition refuses to conclude an agreement on the provision of a subsidy, the Ministry of Industry and Trade of the Russian Federation enters into an agreement with the organization that takes the place next to the place occupied by the organization recognized as the winner of the competition.

18. Based on the results of the competition, an agreement on the provision of a subsidy is concluded between the Ministry of Industry and Trade of the Russian Federation and the organization in accordance with the standard form established by the Ministry of Finance of the Russian Federation.

This agreement must contain:

c) a schedule containing key events in the implementation of a comprehensive investment project in accordance with the business plan and the dynamics of their achievements;

d) the organization’s consent to the Ministry of Industry and Trade of the Russian Federation and the state financial control body conducting inspections of compliance with the goals, conditions and procedure for providing subsidies established by these Rules and the subsidy agreement;

e) schedule financial security expenses associated with the implementation of the investment project.

19. To receive a subsidy, the organization with which the subsidy agreement has been concluded submits the following documents to the Ministry of Industry and Trade of the Russian Federation no more than once a quarter and no later than December 5 of the current year:

Providing free subsidies

Free subsidy for scientific research

3. LEGAL STATUS OF THE GRANT UNDER THE LEGISLATION OF THE RUSSIAN FEDERATION

1. A grant is an amount that is given free of charge. This concept has nothing to do with credit or loan. Issuing grants is the financing of projects that can further benefit society. Let's consider the features of receiving such a subsidy.

Who issues the grants?

What are they and who are they for? They are needed by young, ambitious and talented people. But who is ready to shell out a large sum for the implementation of a project without receiving any certain guarantees? Grants are usually issued by non-profit organizations.
