Article 112 of the Labor Code of the Russian Federation provides that the transfer of days off is carried out for the purpose of rational planning of working time in organizations and taking into account the interests of various categories of citizens of the Russian Federation in creating conditions for proper rest.

For these purposes, Decree of the Government of the Russian Federation dated October 1, 2018 No. 1163 “On the transfer of weekends in 2019” provides for the following shift of weekends:

  • from Sunday 6 January to Friday 3 May;
  • from Saturday 23 February to Friday 10 May.

Work on weekends and non-working holidays in January

According to the law, work on weekends and non-working holidays is prohibited (Article 113 of the Labor Code of the Russian Federation). However, there are exceptions to this rule.

For example, it is allowed to involve an employee in work on a weekend/non-working holiday if there is a need to perform unforeseen work, on the urgent completion of which the further normal functioning of the organization depends.

In this case, the employee can be involved only with his written consent.

Please note that sometimes hiring an employee on weekends/non-working holidays (including in January 2019) is possible without obtaining consent from him.

For example, such situations include the involvement of an employee to prevent a catastrophe/industrial accident or eliminate the consequences of a catastrophe/industrial accident/natural disaster (Article 113 of the Labor Code of the Russian Federation).

How to pay for work on weekends and non-working holidays in January 2019

Work on weekends, as well as non-working holidays, is subject to payment at least double (Article 153 of the Labor Code of the Russian Federation).

The exact amounts of remuneration for work on weekends/non-working holidays (including January 2019) can be specified in the collective agreement, local normative act or an employment contract.

The Labor Code of the Russian Federation has a fairly specific definition regarding working time standards. The vast majority of workers work eight hours a day and work forty hours a week. This situation is due to the fact that organizations and enterprises work mainly five days a week. The working day is usually eight hours a day.

  • for teachers - the length of working hours may depend on the period of study for schoolchildren or students (including the presence of exams for students);
  • for women - some managers may try to make their work easier and reduce them work time; this may be due to the fact that a woman, for example, has a disabled child or children under 14 years of age in her care.

All of the above factors that affect the length of the working week are the most common and common. In labor legislation, there are other categories of citizens who have the right to work part-time.

We add that work in excess of the established norm must be classified as overtime and calculated and paid on the basis of other tariff rates. The employee’s consent to work beyond the norm is mandatory, because otherwise the employer’s actions may be classified as illegal. Overtime work provides incentives for subordinates.

Example of calculating working time standards:

In August 2019, with a five-day work week, which includes two days off, there will be:

  • 22 working days;
  • 9 days off.

In August 2018, the working hours will be:

  • with a 24-hour work week - 105.6 hours (4.8 × 22);
  • with a 36-hour work week - 158.4 hours (7.2 × 22);
  • with a 40-hour work week - 176 hours (8×22).

Calendar for postponing holidays in 2019

Decree of the Government of the Russian Federation dated October 1, 2018 N 1163 provides for the following replacement of days off in 2019:

Thus, in connection with the postponement of holidays in 2019, Russians are traditionally expected long weekend for New Year. They will last 10 days - from December 30, 2018 to January 8, 2019.

Traditionally, May will be generous for holidays and long vacations. In May 2019, Russians will have a rest from May 1 to May 5 in connection with the Spring and Labor Day, as well as from May 9 to 12 in connection with Victory Day.

In November, in connection with the celebration of National Unity Day, the weekend will be extended from 2 to 4 November 2019.
